TERMS OF SERVICE  BOCKETY BOX (IRELAND)

Welcome to Bockety Box. The terms “we”, “us” and “our” refer to Bockety Box Ltd. We operate this website, including all information, content, tools, products, subscription services and features made available to you (the “Services”). Our website is hosted and powered by Shopify.

By accessing, browsing or using our Services, you agree to be bound by these Terms of Service (“Terms”), along with our Privacy Policy, Shipping Policy and Refund & Replacement Policy. If you do not agree with these Terms, you should not use our Services.

1. ACCESS AND ACCOUNT

To use our Services, you must be at least 18 years old, or the age of majority in your place of residence. You agree to provide accurate, complete and current information when creating an account or placing an order.

You are responsible for maintaining the confidentiality of your account credentials, and for all activity carried out under your account. You may not assign, transfer or share your account with another person.

2. OUR PRODUCTS

We make every effort to display accurate images, descriptions and representations of our products. However, appearance (including colour and size) may vary due to seasonal availability, device screens, and natural variation in produce.

All product descriptions and pricing may be changed at any time without notice. We may limit quantities or discontinue products where necessary.

3. ORDERS

When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is only accepted once payment is processed and we confirm acceptance.

Please review your order carefully before submitting. Due to the perishable nature of our goods, order cancellations after acceptance may not be possible.

All purchases are subject to our Refund & Replacement Policy.

You confirm that purchases are for personal or household use only and not for resale or commercial distribution.

4. PRICES AND BILLING

Prices may change without notice. The price applicable at checkout is the price in effect at the time your order is placed.

Prices shown include VAT where applicable but exclude delivery fees for one-off orders, unless stated otherwise.

You agree to provide accurate billing and payment details and keep them updated. You authorise us to charge your payment method for all orders, including recurring subscription payments.

5. SHIPPING AND DELIVERY 

Delivery times are estimates. While we work to ensure timely delivery, delays may occur due to courier issues or circumstances outside our control.

Under Irish and EU consumer law, risk transfers to you only when the goods are physically delivered to your address or safe place, not when they are handed to the courier.

If a courier cannot access your property or the address is incorrect/incomplete, we may be unable to redeliver due to the perishable nature of goods. Please see our Shipping Policy for full details.

6. SUBSCRIPTIONS

By subscribing, you agree to recurring weekly payments until you pause or cancel.

Changes, skips, pauses and cancellations must be made before Sunday at 10am. Changes made after this apply to the following week.

7. STATUTORY RIGHTS 

Nothing in these Terms limits your rights under Irish or EU consumer law.

If goods delivered are:

  • damaged,

  • spoiled,

  • not as described, or

  • of unsatisfactory quality,

you are entitled to a remedy, which may include a replacement, partial refund or full refund, depending on the circumstances.

These statutory protections apply in addition to our Refund & Replacement Policy.

8. INTELLECTUAL PROPERTY

All text, images, logos, graphics, videos and content on our site are the intellectual property of Bockety Box Ltd or our licensors and are protected by Irish and EU copyright and trademark laws.

You may not copy, reproduce, distribute or use our content without written permission.

9. OPTIONAL TOOLS AND THIRD-PARTY LINKS

You may be given access to third-party tools or links. We do not control these and are not responsible for their content or policies. Use of third-party tools or links is at your own risk.

10. RELATIONSHIP WITH SHOPIFY

Bockety Box uses Shopify to operate our online store. However, all sales are made directly between you and Bockety Box Ltd. Shopify is not responsible for any aspect of your transaction.

11. PRIVACY POLICY & GDPR

Your personal information is collected and processed in accordance with:

  • GDPR (EU Regulation 2016/679)

  • Irish Data Protection Act 2018

  • Our Privacy Policy

  • Shopify’s Privacy Policy

By using our Services, you consent to the processing of your data as described in these policies.

12. FEEDBACK

Any feedback, reviews, suggestions or content you submit may be used by us to improve or promote our Services. By submitting content, you grant us a royalty-free, perpetual license to use it, provided such use complies with Irish and EU law.

13. ERRORS AND OMISSIONS

We reserve the right to correct errors, inaccuracies or omissions, and to update information or cancel orders where necessary.

14. PROHIBITED USES

You agree not to misuse our website or violate any laws, cause harm, upload malware, attempt unauthorized access, or engage in behaviour that disrupts our Services.

15. TERMINATION

We may terminate or suspend access to our Services at any time. You remain responsible for any outstanding payments owed up to the termination date.

Provisions that should reasonably survive termination will continue to apply.

16. LIMITATION OF LIABILITY 

To the fullest extent permitted by Irish law, Bockety Box Ltd is not liable for indirect, incidental or consequential damages, except where such limitation is prohibited by consumer protection laws.

Nothing in these Terms limits liability for:

  • fraud

  • death or personal injury caused by negligence

  • violation of statutory consumer rights

17. INDEMNIFICATION

You agree to indemnify and hold harmless Bockety Box Ltd from claims arising from your breach of these Terms or misuse of the Services.

18. SEVERABILITY

If any part of these Terms is found invalid under Irish law, the remaining provisions remain enforceable.

19. GOVERNING LAW 

These Terms are governed by the laws of Ireland.
Any disputes shall be resolved exclusively in the courts of Ireland.

20. CHANGES TO TERMS

We may update these Terms from time to time. The most current version will always be available on this page. Continued use of the Services indicates acceptance of updated Terms.
